These Terms & Conditions (“Terms”) govern your use of the website
avalanchealgarve.com and your bookings with Avalanche Algarve (“we”, “us”, “our”).
By accessing our website, making a booking, or using our services, you agree to be bound by these Terms.
If you do not agree, you should not use our website or services.

Avalanche Algarve is based in Portugal and operates in accordance with applicable Portuguese and EU law.

3. Eligibility

By using our services, you confirm that:

  • You are at least 18 years old; or
  • You are accompanied by, or have the consent of, a responsible adult who accepts these Terms on your behalf.

We may request identification (ID/passport) before completing a rental or tour booking.


4. Website Use

You agree to use our website only for lawful purposes and in a manner that does not:

  • Violate any local, national, or international law or regulation
  • Infringe the rights of any third party
  • Introduce viruses, malware, or other harmful code
  • Attempt to gain unauthorised access to our systems or data

We reserve the right to restrict or block access to the website for users who misuse it.


5. Services We Provide

Avalanche Algarve provides, subject to availability:

  • Rental of bicycles and related equipment
  • Guided cycling tours across selected areas of the Algarve
  • Bike repair, servicing, and mechanical assistance

6. Booking Process & Contract Formation

You may request a booking via:

  • Our online booking or contact forms
  • WhatsApp or telephone
  • Email

A booking is only considered confirmed when:

  • We have received your booking details, and
  • You receive a confirmation message (via email or WhatsApp) from us explicitly accepting the booking.

We reserve the right to refuse or cancel a booking if:

  • The requested equipment is unavailable
  • Weather or safety conditions are not suitable
  • We reasonably believe the bike will be misused or used in unsafe conditions
  • There is a suspicion of fraud or misuse of our services

7. Prices & Payment

All prices are indicated in Euros (EUR) and may vary based on:

  • Bike model or category
  • Rental duration
  • Season and demand
  • Delivery distance or extra services

We will inform you of the applicable price before confirming the booking. We reserve the right to update prices at any time; such changes will not affect bookings already confirmed.

Payment terms (e.g., on delivery, partial deposit, or online payment) will be communicated during the booking process.
Failure to pay in accordance with agreed terms may result in cancellation of the booking.


8. Customer Responsibilities (Bike Rentals)

By renting a bike, you agree to:

  • Use the bike in a safe, responsible manner
  • Follow local traffic laws and regulations in Portugal
  • Wear a helmet and use appropriate safety equipment (we provide a helmet and lock as standard)
  • Not operate the bike under the influence of alcohol, drugs, or medication that impairs ability
  • Secure the bike properly when not in use
  • Return the bike and all accessories at the agreed time and place

You are responsible for any loss, theft, or damage to the bike or accessories beyond normal wear and tear.


9. Condition of Equipment

All bikes are checked and maintained by experienced mechanics. At the time of delivery or handover, you will have the opportunity to inspect the bike and must report any visible issues immediately.

If you notice a mechanical problem during your rental period:

  • Stop using the bike if it is unsafe
  • Contact us as soon as possible via WhatsApp or phone

Continuing to ride a bike that is clearly damaged or unsafe may result in you being held responsible for additional damage.


10. Damage, Theft & Loss

You are responsible for taking reasonable care of the bike and accessories during the rental period.
In the event of:

  • Damage beyond normal wear
  • Theft of the bike or parts
  • Loss of accessories (lock, helmet, lights, etc.)

We may charge an amount reflecting:

  • The cost of repair or replacement
  • Any administrative expenses related to the incident

In case of theft, you should:

  • File a police report as soon as possible
  • Provide us with a copy of the report

11. Safety & Health

Cycling carries inherent risks. By using our services, you acknowledge and agree that:

  • You participate in cycling activities at your own risk
  • You are responsible for assessing your level of fitness and medical condition
  • You will inform us of any relevant health conditions that could affect your ability to ride

We strongly recommend travel or activity insurance that covers cycling and potential injuries.


12. Guided Tours

For guided tours, you agree to:

  • Follow the instructions of the guide at all times
  • Respect local regulations, private property, and nature protection areas
  • Use equipment appropriate for the route difficulty

We reserve the right to refuse participation or exclude any participant whose behaviour is unsafe, disruptive, or disrespectful.


13. Cancellations & Refunds

Our general cancellation rules are described in our separate

  • Free cancellation up to a specified time before the booking (e.g., 12 or 24 hours)
  • Late cancellations or no-shows may result in partial or full charges
  • Weather-related cancellations are handled case by case, with options for rescheduling where possible

14. Late Returns

You must return the bike at the agreed time. If you wish to extend your rental, please contact us as early as possible.

Late returns may incur additional charges based on our daily or hourly rates, as communicated at the time of booking.


15. Force Majeure

We are not liable for any delay or failure to perform our obligations if such delay or failure arises from events outside our reasonable control, including but not limited to:

  • Extreme weather conditions
  • Natural disasters
  • Accidents, road closures, or traffic disruptions
  • Strikes, lockouts, or labour disputes
  • War, riots, or civil disturbances
  • Failure of telecommunications or power networks

16. Liability

We take reasonable care to maintain our bikes and provide safe services. However:

  • We are not responsible for injuries or damages resulting from your misuse of the bike, reckless riding, or failure to follow instructions.
  • We are not liable for loss or damage to your personal belongings during use of our services.
  • To the maximum extent permitted by law, our liability for any claim is limited to the amount you paid for the relevant service.

Nothing in these Terms excludes or limits our liability where such exclusion or limitation is not permitted by law (for example, for death or personal injury caused by our gross negligence).


17. Insurance

Our rentals do not automatically include personal accident or travel insurance for riders.
You are solely responsible for arranging adequate insurance cover for yourself and any companions.


18. Intellectual Property

All content on avalanchealgarve.com, including text, images, logos, and layout, is owned by or licensed to Avalanche Algarve and is protected by copyright and other intellectual property laws.

You may not reproduce, distribute, modify, or use any content from our website for commercial purposes without our prior written consent.


19. Privacy & Data Protection

We process personal data in accordance with our Privacy Policy, which explains in detail how we collect, use, store, and protect personal information, and your rights under GDPR.

By using our website or services, you acknowledge that you have read and understood our Privacy Policy.


20. Third-Party Links

Our website may contain links to third-party websites or services that are not owned or controlled by us.
